Terms of Service

By creating an account, accessing, or using KitabHub in any way, you represent that you are at least 13 years of age (or the minimum age required in your jurisdiction) and that you have read, understood, and agree to be bound by these Terms, our Privacy Policy, our Cookie Policy, our Community Guidelines, and our Acceptable Use Policy, all of which are incorporated by reference.

If you are using the Platform on behalf of an organization (e.g., a publishing house), you represent and warrant that you have the authority to bind that organization to these Terms.

KitabHub supports multiple user roles, including Reader, Author, Translator, Editor, and Publisher. When you register, you choose one or more roles. You are responsible for:

• Providing accurate, current, and complete registration information.
• Maintaining the confidentiality of your account credentials, including any two-factor authentication secrets.
• All activities that occur under your account, whether or not authorized by you.

You must notify us immediately at support@kitabhub.app if you suspect unauthorized access to your account. KitabHub is not liable for any loss arising from unauthorized use of your account.

Ownership. You retain all intellectual property rights to the content you create and post on KitabHub, including reviews, posts, dialogues, reading lists, and profile information ("User Content").

License to KitabHub. By posting User Content, you grant KitabHub a worldwide, non-exclusive, royalty-free, sublicensable, and transferable license to use, reproduce, modify, distribute, display, and perform your User Content solely for the purposes of operating, promoting, and improving the Platform. This license terminates when you delete your User Content or your account, except where your content has been shared with other users or where retention is required by law.

Representations. You represent and warrant that you own or have the necessary rights to post your User Content and that your content does not violate any third-party rights, including copyrights, trademarks, or privacy rights.

You agree not to use the Platform to:

• Violate any applicable law, regulation, or these Terms.
• Harass, bully, threaten, impersonate, or intimidate any person.
• Post content that is defamatory, obscene, hateful, discriminatory, or promotes violence.
• Infringe upon the intellectual property rights of others.
• Distribute spam, unsolicited promotions, or chain messages.
• Attempt to gain unauthorized access to other accounts, computer systems, or networks connected to the Platform.
• Introduce viruses, malware, or other harmful code.
• Scrape, crawl, or use automated means to access the Platform without our prior written consent.
• Interfere with or disrupt the integrity or performance of the Platform.
• Circumvent any content-filtering or security measures.

Violations may result in immediate suspension or termination of your account without prior notice. For detailed guidelines, please review our Community Guidelines and Acceptable Use Policy.

The Platform, including its design, source code, logos, trademarks, brand assets, and all associated intellectual property ("KitabHub IP"), is owned by KitabHub and protected by copyright, trademark, and other intellectual property laws. You are granted a limited, non-exclusive, non-transferable, revocable license to access and use the Platform for its intended purposes. This license does not include the right to:

• Modify, copy, or create derivative works of the Platform.
• Reverse-engineer, decompile, or disassemble any part of the Platform.
• Remove or alter any proprietary notices or labels on the Platform.
• Use KitabHub IP for any commercial purpose without prior written consent.

KitabHub respects intellectual property rights and responds to notices of alleged infringement in accordance with the Digital Millennium Copyright Act (DMCA) and applicable international copyright laws. Your use of the Platform is also governed by our Privacy Policy, which describes how we collect, use, and protect your personal information. KitabHub does not use algorithms to collect user data. We do not access your device unless you explicitly grant KitabHub permission (e.g., camera or file access). We do not sell your personal information, including your username, real name, or images.

The Platform may integrate with or contain links to third-party services, including authentication providers (Google, Apple, LinkedIn), payment processors, and external APIs. KitabHub is not responsible for the content, privacy policies, or practices of any third-party service. Your interactions with third-party services are governed by their respective terms and policies. Use of third-party services is at your own risk.

By KitabHub. We may suspend or terminate your account or access to the Platform at any time, with or without cause, and with or without notice, if we reasonably believe you have violated these Terms, our Community Guidelines, or applicable law, or if your account poses a security risk.

By You. You may delete your account at any time through your account settings or by contacting support@kitabhub.app. Upon deletion, your data will be handled in accordance with our Data Deletion Policy.

Effect of Termination. Upon termination, your right to access the Platform ceases immediately. Sections of these Terms that by their nature should survive termination (including, without limitation, Sections 3, 5, 10, 11, 12, 13, and 14) will survive.

AS-IS BASIS. THE PLATFORM IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. KITABHUB DOES NOT WARRANT THAT THE PLATFORM WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE, OR THAT ANY DEFECTS WILL BE CORRECTED.

LIMITATION OF LIABILITY. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL KITABHUB, ITS DIRECTORS, OFFICERS, EMPLOYEES, AGENTS, AFFILIATES, SUCCESSORS, OR ASSIGNS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM:

• YOUR ACCESS TO OR USE OF (OR INABILITY TO USE) THE PLATFORM;
• ANY CONDUCT OR CONTENT OF ANY THIRD PARTY ON THE PLATFORM;
• ANY CONTENT OBTAINED FROM THE PLATFORM, INCLUDING USER-GENERATED CONTENT;
• UNAUTHORIZED ACCESS, USE, OR ALTERATION OF YOUR TRANSMISSIONS OR CONTENT;
• ANY ACTIONS TAKEN BY THIRD PARTIES, INCLUDING OTHER PLATFORMS, COMPETITORS, OR MALICIOUS ACTORS, THAT AFFECT THE PLATFORM OR ITS USERS;
• ANY DISRUPTION, ATTACK, OR INTERFERENCE WITH THE PLATFORM BY EXTERNAL PARTIES.

IN NO EVENT SHALL KITABHUB'S TOTAL AGGREGATE LIABILITY EXCEED THE GREATER OF ONE HUNDRED U.S. DOLLARS (US$100.00) OR THE AMOUNT YOU HAVE PAID KITABHUB IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

You agree to indemnify, defend, and hold harmless KitabHub, its officers, directors, employees, agents, affiliates, successors, and assigns from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or relating to:

• Your use of the Platform;
• Your User Content;
• Your violation of these Terms or applicable law;
• Your violation of any rights of a third party;
• Any claim that your User Content caused damage to a third party.

KitabHub shall not be liable for any failure or delay in performing its obligations under these Terms where such failure or delay results from any cause beyond our reasonable control, including but not limited to: acts of God, natural disasters, epidemics or pandemics, war, terrorism, riots, civil unrest, government actions or regulations, cyberattacks, distributed denial-of-service attacks, hacking, data breaches caused by third parties, power failures, internet or telecommunications failures, actions of third-party platforms or service providers, or any other force majeure event.

Governing Law. These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which KitabHub is incorporated, without regard to conflict of law principles.

Informal Resolution. Before filing any formal proceeding, you agree to attempt to resolve any dispute informally by contacting us at legal@kitabhub.app. We will attempt to resolve the dispute within thirty (30) days.

Arbitration. Any dispute not resolved informally shall be resolved by binding arbitration in accordance with the rules of a mutually agreed-upon arbitration body. The arbitration shall be conducted in English and the arbitral decision shall be final and binding. You agree to waive any right to a jury trial or to participate in a class action.

Entire Agreement. These Terms, together with the Privacy Policy, Cookie Policy, Community Guidelines, and Acceptable Use Policy, constitute the entire agreement between you and KitabHub regarding the Platform.

Severability. If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.

Waiver. No waiver of any term shall be deemed a further or continuing waiver of such term or any other term.

Assignment. You may not assign or transfer your rights under these Terms without our prior written consent. KitabHub may assign its rights and obligations without restriction.

No Agency. Nothing in these Terms creates a partnership, joint venture, employment, or agency relationship between you and KitabHub.

We reserve the right to modify these Terms at any time. When we make material changes, we will notify you by email, in-app notification, or by posting a prominent notice on the Platform at least thirty (30) days before the changes take effect. Your continued use of the Platform after the effective date constitutes acceptance of the revised Terms. If you do not agree to the updated Terms, you must stop using the Platform and delete your account.
