Copyright & DMCA Policy

KitabHub respects the intellectual property rights of authors, publishers, translators, and all content creators. We respond to notices of alleged copyright infringement in accordance with the Digital Millennium Copyright Act (DMCA) and applicable international copyright laws.

1. Our Commitment

As a platform dedicated to the literary community, we take copyright protection seriously. Books, translations, reviews, articles, and other literary works are the lifeblood of our community, and we are committed to ensuring that creators' rights are respected.

2. User Responsibility

When you post content on KitabHub, you represent and warrant that:

  • You own the content or have obtained all necessary rights, licenses, and permissions to post it.
  • Your content does not infringe the copyright, trademark, or other intellectual property rights of any third party.
  • Quotes, excerpts, and references to other works comply with fair use or fair dealing principles and are properly attributed.

3. Filing a DMCA Takedown Notice

If you believe that content on KitabHub infringes your copyright, you may submit a DMCA takedown notice to our designated agent. Your notice must include:

  1. Identification of the copyrighted work you claim has been infringed. If multiple works are involved, provide a representative list.
  2. Identification of the infringing material and its location on the Platform (e.g., URL, page name, or sufficient detail for us to locate it).
  3. Your contact information, including your full name, mailing address, telephone number, and email address.
  4. A statement that you have a good-faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.
  5. A statement, under penalty of perjury, that the information in the notice is accurate and that you are the copyright owner or are authorized to act on the copyright owner's behalf.
  6. Your physical or electronic signature (or that of an authorized agent).

4. Counter-Notification

If you believe your content was removed in error or that you have authorization to use the material, you may file a counter-notice. Your counter-notice must include:

  1. Identification of the removed material and the location where it appeared before removal.
  2. A statement, under penalty of perjury, that you have a good-faith belief that the material was removed or disabled as a result of mistake or misidentification.
  3. Your name, address, and telephone number, and a statement that you consent to the jurisdiction of the federal court in your district (or, if outside the United States, any judicial district in which KitabHub may be found) and that you will accept service of process from the person who submitted the takedown notice.
  4. Your physical or electronic signature.

Upon receiving a valid counter-notice, we will forward it to the original complainant. If the complainant does not file a court action within ten (10) to fourteen (14) business days, we may restore the removed material.

5. Repeat Infringers

KitabHub maintains a policy of terminating accounts of users who are determined to be repeat infringers. We consider the following factors:

  • The number and nature of takedown notices received.
  • Whether counter-notices were filed and their outcomes.
  • The user's overall compliance history with our policies.

Typically, a user who receives three (3) valid takedown notices within a twelve-month period will have their account terminated.

6. Fair Use

KitabHub recognizes the importance of fair use in literary discussion and criticism. Brief quotations, excerpts for review purposes, and commentary are generally protected under fair use doctrine. We encourage users to:

  • Quote only as much as is necessary for commentary or criticism.
  • Always attribute the source and author of quoted material.
  • Add original analysis, commentary, or critique rather than simply reproducing others' work.

7. Misrepresentation Warning

Under Section 512(f) of the DMCA, any person who knowingly materially misrepresents that material is infringing, or that it was removed by mistake, may be subject to liability for damages, including costs and attorneys' fees. Please consider carefully before submitting a takedown notice or counter-notice.
